    Welcome to Atium Health. These Terms of Service ("Terms") govern your access to and use of the Atium Health website located at www.atiumhealth.com (the "Site") and any related services, including scheduling, virtual therapy sessions, and informational resources (collectively, the "Services"), provided by Atium Health LLC ("Atium Health," "we," "our," or "us"), located at 1398 W State Rd, Pleasant Grove, Utah 84062.

    By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.

    IMPORTANT NOTICE: These Terms contain provisions that limit our liability and require individual arbitration of disputes. Please read them carefully.

    1. Not a Medical Emergency Service

    Atium Health provides outpatient mental health therapy and counseling services. We are NOT a crisis intervention or emergency service. If you or someone you know is experiencing a mental health emergency, imminent risk of harm, or a life-threatening situation, please:

    • Call 911 or go to your nearest emergency room
    • Call or text the 988 Suicide & Crisis Lifeline (call or text 988)
    • Contact the Crisis Text Line by texting HOME to 741741

    Do not rely on our website, email, or scheduling portal to communicate urgent or emergency information.

    2. Services Overview

    Atium Health offers a range of outpatient mental health services, including but not limited to:

    • Individual therapy for depression, anxiety, trauma, and other mental health concerns
    • Couples counseling and marriage therapy
    • Addiction recovery counseling
    • Trauma therapy, including EMDR (Eye Movement Desensitization and Reprocessing) and TF-CBT (Trauma-Focused Cognitive Behavioral Therapy)
    • Betrayal and infidelity therapy
    • Youth and juvenile mental health support (NOJOS program)
    • Support groups and group therapy
    • Virtual (telehealth) and in-person therapy sessions

    The availability of specific services may vary by location, therapist, and scheduling. Nothing on this Site constitutes a guarantee that any particular service, therapist, or treatment modality will be available to you.

    3. No Therapist-Client Relationship

    Browsing this website, submitting an inquiry form, or requesting a free consultation does not establish a therapist-client relationship or any professional relationship of any kind. A formal therapeutic relationship is only established after:

    • You have completed and signed our intake paperwork and consent forms
    • An Atium Health licensed clinician has confirmed acceptance of you as a client
    • You have attended your first scheduled session

    Any information you share with us through the website before a formal relationship is established does not carry the legal protections of therapist-client privilege. Please exercise appropriate discretion.

    4. Eligibility

    To use our Services, you must:

    • Be at least 18 years of age, or have a parent or legal guardian consent on your behalf
    • Be a resident of or physically located in a state where our licensed clinicians are authorized to practice at the time of service
    • Provide accurate, complete, and current information when scheduling or registering

    Our therapists are licensed to practice in Utah and, where applicable, across other states through telehealth licensure. It is your responsibility to verify that our clinicians are authorized to serve clients in your jurisdiction.

    5. Scheduling, Appointments & Cancellations

    5.1 Scheduling

    You may schedule appointments through our website, by calling (801) 785-8885, or by emailing office@atiumhealth.com. Appointment availability is subject to therapist availability and is not guaranteed until confirmed.

    5.2 Cancellations & No-Shows

    We require at least 24 hours' notice to cancel or reschedule an appointment. Late cancellations or no-shows may be subject to a cancellation fee as outlined in your client services agreement. Repeated late cancellations or no-shows may result in termination of services.

    5.3 Free Consultations

    We offer free consultations to prospective clients. Free consultations are not therapy sessions and do not establish a therapeutic relationship. Consultations are typically 15–20 minutes and are intended to help determine whether our services are a good fit for your needs.

    6. Telehealth Services

    Atium Health offers secure virtual therapy sessions. By using our telehealth services, you acknowledge and agree to the following:

    • You are responsible for providing a private, secure, and appropriate environment for your session
    • You are responsible for your own technology, internet connection, and any associated costs
    • Telehealth may not be appropriate for all individuals or all types of mental health concerns; your therapist will advise accordingly
    • You must be physically located in a state where your therapist is licensed to practice at the time of the session
    • Sessions conducted over the internet may carry inherent security risks despite our use of HIPAA-compliant platforms

    In the event of a technology failure during a session, your therapist will attempt to reconnect or contact you via phone.

    7. Insurance & Payment

    Atium Health accepts several insurance plans including Optum, CompSych (excluding EAP programs), United Healthcare, EMI, Select Health (Value, Med, and Choice plans), and UMR. Insurance participation is subject to change.

    It is your responsibility to:

    • Verify your insurance benefits and coverage prior to scheduling
    • Understand your deductible, co-pay, and out-of-pocket obligations
    • Provide accurate and current insurance information
    • Pay any amounts not covered by insurance in accordance with our payment policies

    We do not guarantee that our services will be covered by your insurance plan. Clients are ultimately responsible for payment of all services rendered. Payment terms, fees, and billing policies will be provided in your client services agreement.

    8. Privacy & HIPAA

    As a healthcare provider, Atium Health is subject to the Health Insurance Portability and Accountability Act (HIPAA) and applicable Utah state privacy laws. Your protected health information (PHI) is collected, used, and disclosed in accordance with our Notice of Privacy Practices, which is provided to you at intake and available upon request.

    Our website may collect certain non-health-related information through cookies, contact forms, and scheduling tools. Please refer to our separate Privacy Policy for details on how we collect and use website data.

    By using our website, you acknowledge that internet communications are not fully secure, and while we take reasonable precautions, we cannot guarantee the security of information transmitted through our website outside of HIPAA-compliant platforms.

    9. Disclaimer of Warranties

    THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ATIUM HEALTH LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

    WE DO NOT WARRANT THAT: (A) THE SITE OR SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) ACCESS TO OR USE OF THE SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) ANY INFORMATION OR CONTENT OBTAINED THROUGH THE SITE OR SERVICES WILL BE ACCURATE, COMPLETE, OR RELIABLE; (D) ANY DEFECTS IN THE SITE OR SERVICES WILL BE CORRECTED; OR (E) THE SITE OR SERVICES ARE FREE FROM VIRUSES, UNAUTHORIZED ACCESS, OR OTHER HARMFUL COMPONENTS.

    All content on the Atium Health website — including text, graphics, logos, images, audio clips, and software — is the property of Atium Health LLC or its content suppliers and is protected by applicable United States and international copyright and intellectual property laws.

    You may access and use our Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from this Site without our prior written consent.

    12. User Conduct

    When using our Site or Services, you agree that you will not:

    • Provide false, misleading, or fraudulent information in any form or communication
    • Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
    • Attempt to gain unauthorized access to any part of the Site or related systems
    • Upload or transmit viruses, malware, or any other malicious code

    13. Limitation of Liability

    To the fullest extent permitted by applicable law, Atium Health LLC, its owners, officers, employees, agents, therapists, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of income, emotional distress, or personal injury — arising out of or in connection with your use of, or inability to use, our Site or Services.

    Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount paid by you to Atium Health for the specific service that gave rise to the claim in the three (3) months preceding the claim.

    Some jurisdictions do not allow the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

    14. Indemnification

    You agree to indemnify, defend, and hold harmless Atium Health LLC, its officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of our Site or Services, your violation of these Terms, or your violation of any rights of any third party.

    15. Equitable Relief

    You acknowledge that a violation of these Terms may cause Atium Health LLC irreparable harm that cannot be adequately remedied through monetary damages alone. Accordingly, in addition to any other legal or equitable remedies available to us, Atium Health LLC reserves the right to seek injunctive relief, specific performance, or other equitable remedies in any court of competent jurisdiction to prevent or remedy any breach or threatened breach of these Terms, without the requirement of posting a bond or other security. Nothing in these Terms shall be construed to limit our right to pursue such relief.

    16. Dispute Resolution & Arbitration

    PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

    16.1 Informal Resolution

    Before initiating any formal dispute, you agree to contact us at office@atiumhealth.com and give us 30 days to attempt to resolve the issue informally.

    16.2 Binding Arbitration

    If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or our Services — except for claims involving emergency injunctive relief or claims within the jurisdiction of small claims court — shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Utah County, Utah (or virtually, where applicable). The arbitrator's decision shall be final and binding.

    16.3 Class Action Waiver

    YOU AND ATIUM HEALTH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. CLAIMS OF MORE THAN ONE PERSON CANNOT BE ARBITRATED OR LITIGATED JOINTLY OR CONSOLIDATED WITH THOSE OF ANY OTHER PERSON.

    16.4 Governing Law

    These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law provisions.

    17. SMS & Text Messaging

    Atium Health may communicate with you via SMS or text message for appointment reminders, scheduling updates, and administrative notifications. By providing your mobile phone number and opting in to receive text messages, you authorize us to contact you via SMS.

    Standard message and data rates may apply depending on your mobile carrier plan. Message frequency varies. You may opt out at any time by replying STOP to any message from us, and you may request help by replying HELP. Opting out of SMS communications does not affect your ability to receive our clinical services.

    Our SMS communications are for administrative and scheduling purposes only. Do not use text messaging to communicate urgent clinical concerns or emergency information. If you are experiencing a mental health emergency, call 911 or the 988 Suicide & Crisis Lifeline.

    18. Termination

    We reserve the right to suspend or terminate your access to our Site or Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use our Services will immediately cease.

    You may discontinue use of our Services at any time. Termination of services does not relieve you of any outstanding payment obligations.

    19. Third-Party Links & Services

    Our Site may contain links to third-party websites, scheduling platforms, or resources. These links are provided for convenience only. Atium Health does not endorse, control, or assume responsibility for any third-party sites or services. We encourage you to review the terms and privacy policies of any third-party sites you visit.

    20. Modifications to These Terms

    We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our Site or Services after the posting of changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

    21. Survival

    Certain provisions of these Terms are intended to remain in effect after the termination or expiration of your relationship with Atium Health or your access to our Services. Specifically, the sections governing intellectual property, disclaimers of warranty, limitation of liability, indemnification, equitable relief, dispute resolution and arbitration, and governing law shall survive any termination or expiration of these Terms and continue to apply for their full statutory period or as otherwise required by law.

    22. Severability

    If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable. The failure of either party to enforce any right under these Terms shall not constitute a waiver of that party's right to enforce such provision in the future.

    23. Provider Reviews

    Atium Health may display client reviews of individual therapists on our website. These reviews represent the personal opinions of individual clients and do not constitute clinical advice, diagnosis, or treatment recommendations.

    23.1 Privacy & Anonymity

    To protect client confidentiality, reviews are anonymized prior to publication. Personally identifiable information and protected health information will be removed or redacted from any review before it is displayed publicly.

    23.2 Review Integrity

    We are committed to displaying reviews fairly and without selective manipulation. Reviews are shown as submitted, subject only to edits necessary to protect client privacy or remove content that violates these Terms. We do not remove reviews simply because they are critical, nor do we artificially elevate positive reviews. We reserve the right to remove reviews that contain defamatory statements, discriminatory or hateful language, or content that is false, fabricated, or intended to harm a provider without factual basis.

    23.3 Submission Guidelines

    Reviews must be based on a genuine personal experience receiving services from an Atium Health therapist. Submissions must be respectful and free from abusive, discriminatory, or harassing content. We reserve the right to moderate reviews for compliance with these guidelines.

    23.4 External Reviews

    Nothing in these Terms restricts your right to share your experiences on third-party platforms or review sites. These terms apply only to reviews submitted directly to Atium Health.

    23.5 Therapist Opt-Out

    Therapists may request that reviews not be displayed on their public profile at any time. Opting out removes reviews from public view but does not permanently delete them from our internal records.

    23.6 Formal Complaints

    Reviews submitted through our platform are not a substitute for formal complaint resolution. If your feedback involves a serious clinical or ethical concern, please contact us directly at office@atiumhealth.com to ensure it is handled through the appropriate process.

    24. Entire Agreement

    These Terms, together with our Privacy Policy and any separate client services agreement or consent forms you may sign, constitute the entire agreement between you and Atium Health with respect to your use of our Site and Services. These Terms supersede all prior and contemporaneous agreements, representations, and understandings.
